สถานประกอบการอุตสาหกรรม คือ โรงงาน อาคาร สถานที่ หรือยานพาหนะที่ใช้เครื่องจักร มีกำลังรวมตั้งแต่ห้าสิบแรงม้าหรือกำลังเทียบเท่าตั้งแต่ห้าสิบแรงม้าขึ้นไป หรือใช้คนงานตั้งแต่ห้าสิบคนขึ้นไปโดยใช้เครื่องจักรหรือไม่ก็ตามเพื่อประกอบกิจการ
